Photo Shoot Contract

  1. This agreement contains the entire understanding between Aaron Delaney Photography and the Client. It supersedes all prior and simultaneous agreements between the parties. Only those changes or modifications specifically placed in writing, attached, dated and signed by the Clients and Aaron Delaney Photography at the time of acceptance of this contract shall be recognized as amendments to this contract.

  2. In the event that the Client cancels the contracted services for Photography/ videography outlined in this contract before the photo shoot takes place, the deposit will not be refunded. Aaron Delaney Photography agrees to refund all additional paid money (less expenditures for which receipts will be provided), to the client. (Regarding covid-19 please see paragraph 22)​​

  3. The Client understands and agrees to pay all remaining balance in cash, on the day of the photo shoot.

  4. The Client is not responsible for any extra/unforeseen transport costs of the photographer/ videographer to and from the shoot location. 

  5. If the photo shoot is far away from the photographers residence and a hotel is required, The Client is not responsible for any extra costs of any accommodation required by the photographer/videographer in case of hotel is cancellation.

  6. In the unlikely event of severe medical, natural, or other emergencies, it may be necessary to retain an alternative photographer/videographer, Aaron Delaney Photography will make every effort to secure a replacement photographer of the same professional standing and ability able and/or willing to provide a similar package as chosen in this contract at the same/similar tariff. If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received.

  7. Aaron Delaney Photography takes the utmost care with respect to exposure, transportation and processing of photographs and video. However, in the unlikely event of the Client’s photographs and video being lost, stolen or destroyed for reasons within or beyond Aaron Delaney Photography’s control, the latter’s liability is limited to the return of all payments received for the photo shoot.

  8. The Photographer/Videographer will take photos & videos in the way the see fit.

  9. Prior to or during the shoot, the Client may inform the photographer/ Videographer of subjects which they would like captured, but the final content of the photos is at the discretion of the photographer/videographer..

  10. The client will receive a gallery of edited photos/Edited video. The entire copyright in the photos & video is retained by the photographer/Videographer at all times throughout the world. The client must seek permission for use beyond reproduction and copying for friends, guests and family. No Raw files or footage will be released to the client, only edited photos/video.

  11. The Clients hereby allow the photographer/videographer to display any photos/Video covered by this contract and to generally promote the business by means of advertising, publicity material, websites, exhibitions, competitions, magazine articles, and other such media, providing that the photos are used lawfully and without damage to the Clients.

  12. Drone Footage :-In case of high winds or bad weather the drone will not be able to be flown due to safety concerns for guest and equipment, In the extreme case of a drone not been able to be flown, No charge will be required for drone usage, as stated in the contract.

  13. The photographer/Videographer is limited by the location of the shoot. At some locations there may be limits where the photos can be taken due to respecting the cultural or legal requirements of the venue.

  14. Aaron Delaney Photography will not tolerate any level of verbal abuse or aggression. Either will result in the immediate suspension of coverage.

  15. If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect.

  16. The client understands it will take a few days or weeks for full gallery of edited photos & video to be ready for release to the client. (If any technical issues arise this could be extended but we will inform the client at that point). A small gallery of sneak peek edited photos will be released a few days after the photo shoot
